These terms and conditions exist between you the user and Kaper Ltd trading as Pelvic Peace of Mind (who is the owner and operator of the website). Please read terms and conditions carefully as they will affect your legal rights.

 

Your agreement to comply with and be bound by the terms occurs when you first enter the website. These terms are a legally binding contract between you and Kaper Town Ltd trading as Pelvic Peace of Mind.

 

Use of the Site

 

Information on this site is not a substitute for medical advice and you should seek medical advice via formal channels should you require it. E.g. NHS

 

Rules and Restrictions

 

You should not use the website for any of the following purposes; in a way which causes, or may cause damage to the website or interfaces with any other persons use of it. In any way that is harmful, illegal, malicious, abusive, harassing or threatening or in breach of any law, regulation of government requirement.

 

We grant you a limited non-exclusive, non-transferable and revocable licence to use our services subject to the Terms and following restrictions in particular:

  1. Don’t use our services to break the law

  2. Don’t steel our stuff – You agree not to crawl, scrape or spider any page of the services or attempt to obtain the code of the services without our permission.

  3. Don’t try to harm our systems – You agree not to interfere or try to disrupt our services for example by distributing a virus.

 

Governing Law and Jurisdiction

These terms and conditions supersede any other agreement between you and us to the extent necessary to resolve any inconsistency or ambiguity between them. The terms and conditions are governed by the Law of England and Wales and disputes arising under the agreement including non-contractual disputes or claims shall be subject to the exclusive jurisdiction of the English and Welsh Law.

Amendments to this Agreement

 

We may amend the terms of this Agreement and our policies from time to time. We will make reasonable efforts to notify you of material changes and revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

 

Limitation of Liability

 

We are not responsible for third party content on this website. You use this website at your own risk.

 

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

 

Neither party shall be liable to the other party in connection with this agreement for any indirect, consequential (including without limitation lost profits, business losses, such as income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities, loss or corruption of any data, database or software and any special, indirect or consequential loss or damage), incidental, special or punitive damages, except to the extent caused by our or your liability for death or personal injury resulting from ours or your negligence, ours or your liability for fraud or fraudulent misrepresentation or limit or exclude any of ours or your liabilities in any way that is not permitted under law. We will not be liable to you in respect to any losses (as described above) arising out of events beyond our reasonable control.

 

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

 

Terms and Conditions of Booking/Payments

T&C are dependent on Service

Service: Emsella
We take full payment for treatments at point of booking online to secure the booking(s) or take full payment in person at first treatment appointment to secure future bookings. If you require help to spread your payments, PayPal is available at point of booking online.

We do not charge for a consultation (and/0r mini taster of the Emsella). Only one free taster trial is allowed per customer. Taster is subject to completion and agreement to the New Client Form.

Service: Woman's Pelvic Health Physiotherapy

We take full payment for treatments at point of booking online to secure the booking(s) or take full payment in person at first treatment appointment to secure future bookings. If you require help to spread your payments, PayPal is available at point of booking online.

We do not charge for a consultation. Consultation is subject to completion of the New Client Form and Pelvic Health Questionaire.

Bookings Cancellations & Rearrangement Policy

 

Cancellation Policy

Emsella

Should you choose to cancel or rearrange your treatment appointment, please provide us with at least 24 business hours’ notice. This doesn’t include Sunday or UK bank holidays. If you require to re-arrange an appointment on the day of treatment then do so by phone. There is no charge for rescheduling appointments currently.

 

There is no charge for cancelling a Consultation and free taster session.

If you cancel (with no re-schedule) a treatment package or Top Up treatment with more than 24 business hours’ notice of the treatment package starting you will receive a full refund back to your payment card minus the cost of processing fees (3%).

Please note this is automatic and can take between 10 days processing time by the credit card company depending on the merchant, billing cycle and credit card provider.

Depending on the merchant's policy, most will process a refund instantly, but some take a few extra days, depending on which business days the company operates.

 

If you cancel with less than 24 hour’s notice and no longer wish to have treatment package then the charge will be the cost of sale incurred by Pelvic Peace of Mind (e.g up to 3% paid by Pelvic Peace of Mind at the time of booking the treatment and non-returnable by the payment provider).


If you wish to cancel the treatment package part way through the treatments, then a partial refund will provided on a pro-rated basis minus the processing fee (The average cost per one treatment for the package * the number of treatments left minus the processing fee). There is no additional charges for cancellation part way through a treatment plan.

If you cancel a maintenance package before the first treatment & at least 24 business hours in advance then a full refund will be made minus the processing fees (up to 3%).

 

Cancellations inside of 24 hours will incur the cost of sale incurred by Pelvic Peace of Mind (e.g up to 3% paid by Pelvic Peace of Mind at the time of booking the treatment and non-returnable by the payment provider).

If you wish to cancel a fully pre-paid maintenance plan part way through the treatment, then a partial refund will be provided on a pro-rated basis. If you have subscribed to a maintenance plan to be billed on a 3 monthly basis then you will be charged for the first treatment received and a refund can be provided on a pro-rata basis.  

For maintenance plans, there is no charge for rescheduling appointments currently.

Woman's Health Physiotherapy

Should you choose to cancel or rearrange your Initial treatment appointment, please provide us with at least 24 business hours’ notice. This doesn’t include Sunday or UK bank holidays. Any treatments cancelled or re-scheduled within 24 hours or any no shows to the appointment will be fully charged and a refund will not be provided. This is so we can support all our clients with appointments.

Any treatment package appointments paid upfront can be cancelled and re-arranged provided you provide us at least 24hours notice (this doesn't include Sunday or UK bank holiday) Any treatments cancelled within 24 hours or any no shows to the appointment will be charged and a refund will not be provided. This however will not affect the remaining pre-paid appointments within the package provided they are attended and not cancelled within the 24 hour notice period required. 

Should you choose to cancel or rearrange your ongoing appointments please provide us with at least 24 hours business hours notice. This doesn't include Sunday or UK bank holidays.  Any pre-paid appointments not cancelled  or re-arranged or not attended (no shows) in line with this will be subject to full charge. No refunds.

 

Any appointments booked and cancelled or not attended where payment is due in person currently are not charged, however failure to attend and/or cancel inside of the notice period will be subject to upfront payment during the booking process for any further appointments.

 

Warranties

 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted or error free and that time to time we may remove the service for periods of time or cancel the service at any time without notice to you. You expressly agree that your use of or inability to use the services is at your sole risk.

It is permissible to link to content from this site as long as the original source is clearly stated, but the wholesale reproduction or partial modification of content is not permitted.

Pelvic Peace of Mind is trademarked and the logo cannot be used under any circumstances. Exceptions are granted only if you receive prior written consent by Kate@Pelvicpeaceofmind.co.uk.  Failure to comply may lead to prosecution to the fullest extent permission under applicable laws.
